Willowmaindens Garden requires personal data, particularly when you place an order in the webshop. The following personal data may be processed:

- Your first and last name / details of the provided contact person

- Contact information such as email and phone number

Why Willowmaindens Garden Needs This Data

This data is necessary to process orders, keep you informed about the status of your order, and/or to respond to you (when filling out the contact form).

Legal Grounds for Data Processing

Willowmaindens Garden processes and retains personal data based on the grounds of ‘performance of the contract’ and ‘legal obligation.’ For any marketing activities, the ground is ‘consent’; Willowmaindens Garden will never use data for other purposes without explicit consent.

Duration of Data Retention

Data will not be kept longer than strictly necessary. If there is no order or assignment following a contact moment, your data will be retained for a maximum of 1 year. After completing an order or assignment, your personal data will not be retained longer than 6 months. Only the data needed for tax declarations (ground of legal obligation) will be retained for 7 years.

Personal data will not be shared with third parties without necessity. Your data will only be shared with third parties if required for the execution of the agreement/order or to comply with legal obligations.

Parties with whom your data may be shared (if applicable):

 

Tax Authority – To comply with legal obligations, it is necessary to share personal data with the Tax Authority. They can request access to my records, to which I am legally obliged to comply.

 

Transport Company – To deliver orders, I use transport companies such as PostNL and DHL. It is necessary to share your name and address with these parties. Both PostNL and DHL will use the data solely for the purpose of delivering your order.

If you live in certain areas, including the EU, you have a number of rights regarding your personal data. I describe those rights below:

 

Access – You have the right to view your personal data that I have stored. You can do this by sending me a message.

 

Modification, Limitation, or Deletion – You may have the right to modify your personal data, limit my use of it, or delete it. If no other grounds apply (such as retention for legal obligations), I will generally delete your personal data upon request.

 

Objection – You can object to my processing and storage of (parts of) your data. In such cases, I will delete your personal data unless I am legally obligated to retain your data (for example, for legal obligations).

 

Complaints – If you live in the EU and believe I am mishandling your personal data, you have the right to file a complaint with the local data protection authority.

All requests regarding access, modification, limitation, deletion, or objection to your personal data will be answered within a maximum of 4 weeks.
